The Maker Porch Marketplace Seller Agreement

Effective Date: May 30, 2026

This Seller Agreement ("Agreement") governs participation as a seller on The Maker Porch Marketplace ("The Maker Porch," "Marketplace," "we," "our," or "us"). By registering as a seller, listing products, or conducting sales through the Marketplace, you agree to be bound by this Agreement.

1. Seller Eligibility

To sell on The Maker Porch Marketplace, you must:

• Be at least 18 years old.
• Have the legal authority to enter into binding agreements.
• Provide accurate and complete account information.
• Maintain current contact and payment information.

The Maker Porch reserves the right to approve, reject, suspend, or terminate any seller account at its sole discretion.

2. Seller Responsibilities

Sellers agree to:

• Provide accurate product descriptions and photographs.
• Maintain accurate inventory levels.
• Ship orders within the stated processing time.
• Respond to customer inquiries promptly.
• Comply with all applicable laws and regulations.
• Conduct business honestly and professionally.

Sellers are solely responsible for the products they offer and the content they publish.

3. Product Standards

Products listed on The Maker Porch Marketplace must be:

• Handmade by the seller, designed by the seller, personalized by the seller, vintage, or otherwise approved by the Marketplace.
• Accurately represented in listings.
• Safe for intended use.
• Compliant with all applicable laws and regulations.

The Marketplace may remove any listing that does not meet these standards.

4. Prohibited Products

Sellers may not list products prohibited under the Marketplace Prohibited Items Policy.

This includes, but is not limited to:

• Counterfeit goods
• Copyright or trademark infringing products
• Illegal products
• Weapons
• Hazardous materials
• Adult content
• Stolen merchandise

Violations may result in immediate account suspension or termination.

5. Intellectual Property

Sellers represent and warrant that:

• They own or have permission to use all content, images, trademarks, and materials associated with their listings.
• Their products do not infringe upon the intellectual property rights of others.

Sellers agree to indemnify and hold harmless The Maker Porch from any intellectual property claims arising from their listings or products.

6. Order Fulfillment

Sellers agree to:

• Ship orders within the processing times stated in their listings.
• Provide tracking information when available.
• Package products appropriately to prevent damage during transit.

Failure to fulfill orders consistently may result in account restrictions.

7. Returns and Customer Service

Sellers agree to:

• Comply with the Marketplace Returns & Refunds Policy.
• Respond to customer concerns within a reasonable timeframe.
• Work in good faith to resolve disputes.

The Maker Porch may intervene in disputes when necessary.

8. Marketplace Fees

Sellers agree to pay all applicable marketplace fees, commissions, subscription fees, advertising fees, or other charges disclosed by The Maker Porch.

Fees are subject to change upon notice by the Marketplace.

9. Seller Account Reviews

The Maker Porch reserves the right to:

• Review seller accounts.
• Request additional documentation.
• Verify business information.
• Monitor performance metrics and customer satisfaction.

10. Account Suspension and Termination

The Marketplace may suspend or terminate a seller account for:

• Policy violations
• Fraudulent activity
• Excessive customer complaints
• Intellectual property violations
• Failure to fulfill orders
• Misrepresentation of products
• Conduct harmful to the Marketplace or its users

The Maker Porch may remove listings without prior notice when necessary.

11. Indemnification

Seller agrees to defend, indemnify, and hold harmless The Maker Porch Marketplace, its owners, affiliates, employees, contractors, and agents from any claims, damages, liabilities, costs, or expenses arising from:

• Seller products
• Seller listings
• Seller conduct
• Seller violations of this Agreement
• Seller violations of law

12. Limitation of Liability

The Maker Porch Marketplace acts solely as a platform connecting buyers and sellers.

To the fullest extent permitted by law, The Maker Porch shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from seller participation in the Marketplace.

13. Modifications

The Marketplace reserves the right to modify this Agreement at any time. Continued use of the Marketplace after modifications constitutes acceptance of the updated Agreement.

14. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Georgia, without regard to conflict of law principles.

15. Acceptance

By registering as a seller or listing products on The Maker Porch Marketplace, you acknowledge that you have read, understood, and agree to be bound by this Seller Agreement, the Terms of Service, the Returns & Refunds Policy, and the Prohibited Items Policy.
